2000 Legislative Recap

 During the 2000 Minnesota Legislative Session five bills dealing with
charitable gambling were passed by the Minnesota Legislature and signed
into law by Governor Jesse Ventura. These bills are highlighted below:

ACM's Charitable Gambling Policy Bill

 On Friday, March 31, 2000 Governor Ventura signed into law Chapter No.
300 S.F. No. 2903. This bill, authored by Senator Jim Vickerman of Tracy
and Representative Mike Osskopp of Lake City, makes the following
changes in Minnesota Statutes chapter 349:

* Allows the Gambling Control Board by rule to prescribe other
qualifications to become a gambling manager.

* Allows members of military marching, color guard, or honor guard units
to be reimbursed for events in state up to $35 per occasion.

* Allows an organization that owns it's premises to elect to continue
paying real estates taxes & assessments as a lawful purpose as currently
allowed, or to pay itself up to $1,000 per month for the use of its
premises for lawful gambling as an allowable expense (subject to
allowable expense % restrictions).

* Specifies licensed manufacturer sales refusal conditions.

* Allows tickets for a meat or merchandise raffle to be sold throughout
the permitted premises.

* Allows a licensed organization to obtain a multi-day off-site permit
for lawful gambling in connection with a county fair, the state fair, a
church festival, or a civic celebration.

* Allows prizes for a meat or merchandise raffle to be paid for within
30 days.

* Requires a trade area defined by a city to include each contiguous
township as well as each contiguous city.


 S.F. No. 2903, passed the Senate on Monday, March 20, 2000 by a vote of
60-0, and passed the House of Representatives on Thursday, March 23,
2000 by a vote of 109-22.

 Chapter No. 300 S.F. No. 2903 went into effect on Saturday, April 1,
2000.

ACM's Lawful Gambling Fraud Bill

 On Monday, April 3, 2000 Governor Ventura signed into law Chapter No.
318 S.F. No. 2701. This bill, authored by Senator Deanna Wiener of Eagan
and Representative Sherry Broecker of Little Canada, makes the following
changes in Minnesota Statutes chapter 609:
* Creates and defines the crime of  lawful gambling fraud.

* Provides criminal penalties for lawful gambling fraud.


 S.F. No. 2701, passed the Senate on Monday, March 20, 2000 by a vote of
61-0, and passed the House of Representatives on Monday, March 27, 2000
by a vote of 128-0.

 Chapter No. 318 S.F. No. 2701 is effective on Tuesday, August 1, 2000.

Public Safety's Gambling Bill

 On Thursday, April 6, 2000 Governor Ventura signed into law Chapter No.
336 S.F. No. 2828. This bill, authored by Senator Chuck Wiger of North
St. Paul and Representative Mike Osskopp of Lake City, makes the
following changes in Minnesota Statutes chapter 349:
* Creates a new lawful purpose for community arts organizations and programs.

* Adds to contraband definition.


 S.F. No. 2828, passed the Senate on Thursday, March 30, 2000 by a vote
of 57-3, and passed the House of Representatives on Wednesday, March 29,
2000 by a vote of 92-38.

 Chapter No. 336 S.F. No. 2828 went into effect on Friday, April 7, 2000.

Omnibus Tax Bill

 On Monday, May 15, 2000, Governor Ventura signed into law Chapter No.
490 H.F. No. 4127. This bill, authored by Representative Ron Abrams of
Minnetonka & Senator Doug Johnson of Tower, makes the following changes
in Minnesota Statutes chapter 297E:
* Net Receipts Tax on bingo, paddlewheels, & raffles reduced from 9.0%
to 8.5%

* Tax Credit for Certain Raffles

* Ideal Gross Tax on pull-tabs & tipboards reduced from 1.8% to 1.7%

* Combined Receipts Tax on pull-tabs & tipboards reduced from
1.8%-3.6%-5.4% to 1.7%-3.4%-5.1%


 H.F. No. 4127, repassed the House of Representatives on Tuesday, May 9,
2000 by a vote of 124-6, and repassed the Senate on Tuesday, May 9, 2000
by a vote of 64-1.

 Sections 3, 5, & 6 of Article 10 (Special Taxes) of Chapter No. 490
H.F. No. 4127 are effective on Saturday, July 1, 2000. Section 4
ofArticle 10 (Special Taxes) of Chapter No. 490 H.F. No. 4127 is
effective on Tuesday, August 1, 2000.

Revisor's Bill

 On Tuesday, May 30, 2000, Governor Ventura signed into law Chapter No.
499 S.F. No. 3819. This bill, authored by Senator David Knutson of
Burnsville and Representative Jim Seifert of Woodbury, makes the
following changes in Minnesota Statutes chapter 349:
 
* Technical correction to licensed manufacturer sales refusal conditions.


 S.F. No. 3819, passed the Senate on Wednesday, May 17, 2000 by a vote
of 59-0, and passed the House of Representatives on Wednesday, May 17,
2000 by a vote of 121-5.

 Section 2 of Chapter No. 499 S.F. No. 3819 went into effect on
Saturday, April 1, 2000.
